what will i need to have with me to try and file bankruptcy, chapter 13, first thing in morning and
have foreclosure stopped before 12:30pm tomorrow?

Additional Details:
ive been trying to get a loan modification, first through my mortgage company, and now working with
Home Retention Solutions and Management. we was told sale date would most likely be postponed (which
it was twice) so not to worry about it.. this afternoon i recieved a phone call needing updated
information asap because freddie mac has stopped postponing foreclosures and that they are trying to
do what they can before sale date which is tomorrow at 12:30. after all day of faxing the requested
information, they tell me that everything has been submitted to be reviewed and we should have a
answer, hopefully, before 10:30am. they suggested i go to a foreclosure or bankruptcy lawyer first
thing in the morning and file chapter 13 to have foreclosure stopped, is this even possible

Yes, you can typically file a bankruptcy quickly if your situation calls for it. Something most people are not aware of is that in North Carolina there is a 10 day upset bid period. This means even if the house has sold at a foreclosure if you file the bankruptcy within 10 days then you can still stop the foreclosure. You would want to talk to a bankruptcy lawyer in your area to see if you can realistically file the bankruptcy.
