What kind of lawyer do i need if Bank of America granted me a 1 year forebearance but upon
completion will not accept my payments and is foreclosing

Additional Details:
I had never missed or payment and paid them all on time but was asking about refinancing. the bank
suggested loan modification because interest rate was high. After 3 months I was also given a 1 year
foreberance. When the year was up and asked about making my old payments and they told me they will
only accept a payment to cover all late money including penalties. Over 10,000. I have a letter from
the bank saying that I can now make my regular payments but no one will listen. What kind of lawyer
do I seek to help them honor the foreberance and to help me avoid foreclosure?

You either want a Contract Attorney to litigate the contract or a Bankruptcy Attorney to either file Chapter 7 Bankruptcy or Chapter 13 Bankruptcy. In your situation I believe a Chapter 13 Bankruptcy Attorney is what would get you the best result. When you file for Chapter 13 Bankruptcy the Automatic Stay would stop any foreclosure proceedings and you could come up with a plan to repay the mortgage over time.

I have responded to your inquiry according to the laws of Massachusetts, where I practice. Laws can vary significantly from state to state and cases tend to be rather fact-specific, so you are best served by consulting with a knowledgeable attorney in weighing your options.
