Q.

Can I file for bankruptcy if I have not filed income taxes in a few years?

A.

You are not barred from seeking bankruptcy by reason of unfiled tax returns. Any tax you owe for years for which there is no return is not discharged in a Chapter 7 bankruptcy. You will need to provide the trustee with the last return you have filed.

If you choose a Chapter 13 bankruptcy, you will need to get current on your tax returns.
