Spouses Don't Have to File Together
Cathleen Cooper Moran

Q.

Can my husband file bankruptcy without including me, his wife?

-- Anonymous

A.

Each individual gets to make the decision whether to file bankruptcy or not. So, one spouse can file a bankruptcy case without his spouse joining in the filing.

The discharge issued in a case involving only one spouse protects only the person who filed bankruptcy from their creditors.
